Terms of Use

Last updated: September 17, 2026

These Terms of Use (“Terms”) govern your use of webemergency.ca and WebEmergency’s website-audit services (the “Service”). By requesting an audit, purchasing a Full Audit, or otherwise using the Service, you agree to these Terms.

1. Who We Are

WebEmergency is operated by Nikolay Pustovit, an individual carrying on business as WebEmergency, from Ontario, Canada.

2. The Service

WebEmergency provides automated SEO and website-audit tools, including:

  • a Free Website Audit, which provides a limited automated review of a website submitted by you; and
  • a paid Full Audit, which provides a deeper automated review, as described at checkout.

Reports are generated using automated systems and third-party data sources. They are informational and diagnostic tools only. They are not legal, financial, cybersecurity, accessibility, marketing, or professional consulting advice, and they do not guarantee rankings, traffic, revenue, conversions, or any other business result.

3. Your Responsibilities

You represent that you own, operate, or have authority to request an audit of each website and any analytics data you submit.

You must not:

  • submit a website or data you are not authorized to submit;
  • submit passwords, sensitive personal information, payment information, or unlawful content;
  • use the Service to overload, disrupt, probe, or gain unauthorized access to a system;
  • attempt to bypass rate limits, security measures, or other limits of the Service; or
  • use reports or the Service for unlawful, misleading, or harmful purposes.

We may refuse, suspend, or limit the Service where necessary to protect users, third parties, or our systems.

4. Full Audit Price, Payment, and Refunds

The price of a Full Audit will be shown in Canadian dollars before payment. Applicable taxes and mandatory charges will be disclosed at checkout.

Payment provider: Stripe

Refund policy

After you order a Full Audit, we may request access to analytics/tracking data and hold off starting for up to one week. You can cancel and get a full refund any time during that week. If you do not cancel within that window, we proceed with the audit (with or without that access) and the purchase is no longer refundable, except where we fail to deliver the report or the audit materially fails to match the described scope because of our error.

Nothing in these Terms limits any non-waivable rights available under applicable consumer-protection law.

5. Accuracy and Availability

Audit findings reflect information available when the audit runs. Websites, search results, third-party data, and technical conditions can change quickly. We do not promise that an audit will be complete, error-free, current, or suitable for a particular purpose.

The Service is provided on an “as is” and “as available” basis, to the extent permitted by law.

6. Intellectual Property

WebEmergency and its software, branding, designs, and audit methodology are owned by or licensed to WebEmergency.

You may use your audit report for your own internal business purposes. You may not resell, reproduce as your own product, reverse engineer, or redistribute the Service or its report-generation software without our written permission.

7. Third-Party Services and Links

Reports may include information from third-party sources, including DataForSEO and Google PageSpeed Insights. We do not control those services and are not responsible for their availability, accuracy, or policies.

8. Limitation of Liability

To the maximum extent permitted by law, WebEmergency will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, rankings, traffic, or business opportunity arising from the Service.

To the maximum extent permitted by law, WebEmergency’s total liability for any claim relating to a paid Full Audit is limited to the amount you paid for that specific audit. For a Free Website Audit, total liability is limited to CAD $0.

9. Indemnity

To the extent permitted by law, you will indemnify and hold WebEmergency harmless from claims, losses, or expenses arising from your breach of these Terms, your unauthorized submission of a website or data, or your unlawful use of the Service.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be brought before the courts located in Ontario, unless applicable law requires otherwise.

11. Changes to These Terms

We may revise these Terms from time to time. The revised version will be posted on this page with an updated “Last updated” date. Your use of the Service after the effective date of the revised Terms constitutes acceptance of the revised Terms, to the extent permitted by law.
